Ochly is operated by Gary Marshall.
For the purposes of applicable UK data protection law, Gary Marshall is the data controller for personal information collected through the Ochly website and handled directly by Ochly.

1. About this Privacy Policy
This Privacy Policy explains how Ochly handles personal information when you:
- visit the Ochly website;
- request access to the Ochly Android beta;
- contact Ochly for support or another enquiry; or
- use the Ochly Android app.
Ochly is currently in beta and this policy may be updated as the website and app develop.
2. Information collected through the Ochly website
Beta access requests
If you request access to the Ochly Android beta, we collect:
- your first name;
- your email address;
- your Android phone model;
- how often you play darts;
- any optional information you provide about what you would like to test; and
- confirmation that you are aged 18 or over.
We use this information to review beta applications, select testers, contact applicants about beta testing and manage the Ochly beta programme.
Submitting a beta request does not guarantee access to the beta.
Support and contact enquiries
If you contact Ochly by email, we may receive information including:
- your name;
- your email address;
- the contents of your message; and
- any other information you choose to provide.
We use this information to respond to your enquiry and provide support.
Technical website information
The Ochly website is hosted using ChatGPT Sites.
The website hosting provider may process technical information required to host, maintain, secure and operate the website. This may include information such as:
- IP address;
- browser and device information;
- log information;
- website usage information; and
- information collected through cookies or similar technologies used to operate the service.
Ochly does not currently add its own advertising trackers or third-party behavioural analytics tools to the website.
If this changes, this Privacy Policy will be updated and any legally required consent controls will be introduced.
3. Information stored by the Ochly Android app
Ochly does not currently require an online account, registration or login.
The current Ochly Beta 1 app stores its main data locally on the user's Android device.
This may include player profile information such as:
- first name;
- surname;
- optional darts nickname;
- optional home venue;
- optional favourite double; and
- an optional profile photograph or local image reference.
Match and gameplay information may include:
- completed match history;
- active or unfinished matches;
- player and opponent names;
- game and match format;
- Solo, Friend or Ochly AI opponent type;
- Ochly AI level;
- match results;
- legs and sets;
- recorded visits and scores;
- remaining scores;
- darts thrown;
- busts;
- checkout attempts and completed checkouts;
- darts at double;
- averages;
- first-nine information;
- highest scores and checkouts; and
- 60+, 100+, 140+ and 180 statistics.
Saved darts equipment information may include:
- setup name;
- brand or barrel;
- weight;
- points;
- stems;
- flights;
- notes; and
- your currently selected setup.
Stored preferences may include:
- default game;
- default opponent type;
- default in and out rules;
- sound preference;
- vibration preference;
- checkout-guide preference; and
- live-average preference.
Statistics, achievements, My Journey information and activity information are calculated from locally stored app data.
4. Where Ochly app data is stored
The current Ochly Beta 1 app uses local Android application storage.
Ochly currently has:
- no Ochly cloud database;
- no online player-account system;
- no automatic cloud synchronisation of match or profile data;
- no advertising SDK;
- no analytics SDK; and
- no automatic gameplay-data upload to an Ochly server.
Ochly does not currently automatically receive your locally stored match history, statistics or player profile.
5. Match-history backups
Ochly allows users to export and import match-history backup files.
When you export a backup:
- Ochly creates a backup file on your device;
- Android's share functionality is opened; and
- you decide where the file is sent or saved.
A backup is only transmitted to another destination if you choose that destination.
Once you share or save a backup outside Ochly, that copy is handled by the application, storage provider or service you selected.
Ochly does not automatically upload those backups to an Ochly server.
6. Profile photographs and device features
If you choose a profile image, Ochly uses Android's image-selection functionality to allow you to select an image.
Ochly may store a local reference to the selected image and Android or the relevant image-selection component may create local cache or edited copies.
Ochly does not intentionally use your location, contacts or advertising identifier and does not intentionally record audio.
The current app uses Android system features such as the photo picker, document picker and share sheet when you choose to use the relevant features.
7. Android device backup
Android may automatically include eligible locally stored Ochly data in the device or Google account backup system if automatic device backup is enabled.
Whether this happens depends on:
- your Android version;
- your device configuration;
- your Google account settings; and
- your backup preferences.
This backup is provided by Android/Google rather than by an Ochly cloud service.
Data restored through Android's backup system may reappear after Ochly is reinstalled.
8. How we use personal information
We use personal information only where there is an appropriate legal basis.
Beta programme
We have a legitimate interest in operating and improving Ochly, selecting suitable beta testers, administering beta access and communicating with people who have requested to participate.
People who submit a beta request would reasonably expect us to use the information they provide for these purposes.
We do not use beta requests to sign people up automatically for unrelated marketing.
Support and enquiries
We have a legitimate interest in receiving and responding to enquiries, providing support and communicating with people who contact Ochly.
App functionality
Local processing within the Ochly app is used to provide the scoring, match-history, statistics, equipment, settings and progression features that the user chooses to use.
Legal requirements
We may also process or retain information where necessary to comply with applicable law, establish or defend legal claims, prevent misuse or protect the security of Ochly and its users.
9. Services that may process information
Formspark
Ochly uses Formspark to process beta-access form submissions.
Information entered into the beta-request form is transmitted to Formspark so the request can be delivered and managed.
Formspark may also process technical submission information including the visitor's IP address, browser type and referring website address as part of providing the form service.
Formspark states that information submitted through its service is transferred to and stored in Ireland.
Google Gmail
Ochly uses Gmail for beta-request notifications, support and other communications.
Information included in emails sent to or from Ochly may therefore be processed by Google in accordance with Google's applicable privacy and service terms.
OpenAI / ChatGPT Sites
The Ochly website is hosted using ChatGPT Sites provided by OpenAI.
OpenAI processes information required to host, maintain, secure and support the published website. This may include website content and technical information generated through visitors' use of the site, such as logs, device information, usage information and information collected using cookies or similar technologies.
ChatGPT Sites does not currently guarantee data residency for published Sites.
User-selected services
Information may also be processed by services that you personally choose to use, for example when you:
- share an Ochly backup;
- save an exported backup;
- select a profile photograph;
- choose a document to restore; or
- use Android/Google device backup.
Those services operate under their own privacy terms.
10. International processing
Some service providers used to operate the Ochly website or communications may process information outside the United Kingdom.
Where required by applicable data protection law, appropriate contractual or other safeguards are used by the relevant service providers for international processing and transfers.
Formspark states that information provided through its service is stored in Ireland.
11. How long information is kept
We keep information only for as long as reasonably necessary for the purpose for which it was collected.
Beta-request information is retained while reasonably required to:
- review the application;
- operate the beta programme;
- communicate with the applicant; and
- maintain appropriate records relating to beta testing.
We periodically review information we hold and delete it when it is no longer reasonably required, unless longer retention is required by law or necessary for legal claims.
Support and contact correspondence may be retained for as long as reasonably necessary to deal with the enquiry and maintain appropriate records.
Locally stored Ochly data generally remains on the device until it is changed, removed through available app functionality, removed by the operating system or the app is uninstalled.
The current Beta 1 app does not provide a complete in-app function for deleting all completed match history or the entire player profile.
Normally, uninstalling Ochly removes app-private local storage and cache data. However, eligible information may subsequently be restored through Android's automatic backup system.
Files that you have manually exported, shared or saved outside the app are not removed when Ochly is uninstalled.
12. Security
We take reasonable measures to protect personal information handled through Ochly.
We also use third-party providers that maintain their own technical and organisational security measures.
However, no method of electronic storage or transmission can be guaranteed to be completely secure.
Users should take appropriate care when choosing where to save or share exported Ochly backup files because they may contain detailed match information.
13. Your data-protection rights
Depending on the circumstances and applicable law, you may have rights including the right to:
- ask for access to personal information we hold about you;
- ask us to correct inaccurate information;
- ask us to delete information;
- ask us to restrict certain processing;
- object to certain processing;
- request a copy of certain information in a portable format; and
- withdraw consent where processing is specifically based on consent.

Ochly cannot remotely access or delete data that exists only in local storage on your Android device and has never been sent to Ochly.
14. Children and beta access
The Ochly website beta-access application is only available to people aged 18 or over.
Applicants must confirm that they are at least 18 before submitting a beta request.
We do not knowingly use the beta form to collect personal information from children.
If you believe that a person under 18 has submitted personal information through the beta form, contact ochlyapp@gmail.com so that we can review and remove it where appropriate.
15. Advertising and analytics
The current Ochly Beta 1 Android app contains:
- no advertising SDK;
- no analytics SDK;
- no behavioural tracking SDK; and
- no third-party crash-reporting SDK.
The Ochly website does not currently intentionally use advertising or behavioural analytics tools.
The website hosting service may process technical data and use cookies or similar technologies as necessary to host, operate and secure the site.
16. Changes to this Privacy Policy
Ochly is an actively developing product.
We may update this Privacy Policy when:
- Ochly features change;
- the website changes;
- new services or providers are introduced;
- the way information is stored or processed changes; or
- legal requirements change.
The latest version will be made available through the Ochly website and the date at the top of this policy will be updated.
