These Terms & Conditions apply to your use of the Ochly website, the Ochly Android app and participation in the Ochly beta programme.

1. About Ochly

Ochly is a darts scoring, statistics and player-progress application.

The current version of Ochly is an Android beta product that is being tested and developed before wider public release.

The Ochly website provides information about the app and allows eligible users to request access to the beta programme.

2. Accepting these Terms

By using the Ochly website, requesting beta access or using the Ochly beta app, you agree to comply with these Terms where they apply to you.

You should also read the Ochly Privacy Policy, which explains how personal information is handled.

If you do not agree with these Terms, you should not participate in the Ochly beta programme or use the beta app.

3. Beta eligibility

The current Ochly beta-access programme is available only to people aged 18 or over.

When requesting beta access, you must provide accurate information and confirm that you are at least 18 years old.

Submitting a beta request does not guarantee that you will be given access.

Ochly may limit the number of testers, select testers based on testing requirements and introduce additional testers over time.

4. Beta access

If you are accepted as a beta tester, access is provided for testing and evaluation purposes.

Beta access is currently provided free of charge.

Ochly may release updated beta versions, require testers to update, add/change/remove beta features, temporarily suspend parts of the beta, limit testing places or end the beta programme.

Where practical, reasonable notice will be given of significant changes that affect existing testers.

Any future paid version, subscription or paid feature will be clearly identified before a user is asked to purchase it and may be subject to additional terms.

5. Beta software

Ochly is still under active development.

Beta software may contain bugs, incomplete features, performance issues, unexpected behaviour, scoring or statistics errors, or features that change before public release.

We will take reasonable care in developing and operating Ochly, but participation in a beta programme necessarily involves testing software that has not yet reached its final release state.

6. Darts scoring and statistics

Ochly is designed to assist with darts scoring, match records, statistics and player progression.

You remain responsible for checking scores and match information where accuracy is important.

If Ochly is used during a league, tournament or organised competition, the rules and decisions of the relevant organiser, official or competition take priority over information displayed by Ochly.

Statistics, averages, checkout information, achievements and progress information are intended as tools to help users understand their darts performance.

7. Your match and profile data

The current Ochly Beta 1 app stores its main profile, match, equipment, settings and statistics information locally on the Android device.

Ochly does not currently operate an online player-account system or Ochly cloud database for this information.

Because beta software can change or contain defects, users should keep an exported backup of match history where they consider that information important.

Nothing in these Terms removes any legal right you may have where data loss or another problem results from Ochly failing to meet an obligation imposed by law.

8. Backup files

Ochly may allow you to export and import match-history backup files.

You are responsible for deciding where exported files are saved or shared.

When you deliberately share a backup with another app, cloud-storage provider or person, that destination may process or retain the information contained in the file under its own terms and privacy practices.

You should take reasonable care when sharing backup files because they may contain detailed match records and player or opponent names.

9. Acceptable use

You must not misuse the Ochly website or app.

You must not knowingly:

• use Ochly for unlawful purposes;
• attempt to damage, disrupt or interfere with the website, app or associated services;
• attempt to gain unauthorised access to systems or information;
• introduce malicious software or harmful code;
• abuse or intentionally overload beta forms or services;
• impersonate another person when requesting beta access;
• use automated systems to submit fraudulent or abusive requests; or
• use Ochly in a way that infringes another person's legal rights.

Nothing in these Terms prevents activities that cannot lawfully be restricted, including rights you may have under applicable law.

10. Intellectual property

Unless stated otherwise, the Ochly software, website, logo, branding, visual design, written content and original materials are owned by or licensed to Gary Marshall.

Third-party software, libraries, services and other materials remain the property of their respective owners and may be subject to their own licences.

You may use Ochly for normal personal use and for legitimate darts activities in accordance with these Terms.

You may not copy, sell, distribute or commercially exploit Ochly's proprietary software, branding or website content without permission, except where applicable law expressly allows you to do so.

Your own profile information, match information, photographs and other original information that you provide remain yours.

11. Feedback

Beta testers are encouraged to report bugs, suggest improvements and provide feedback about Ochly.

If you voluntarily provide feedback, you allow Ochly to use that feedback to develop, improve and promote the product without being required to pay compensation for the suggestion itself.

You retain ownership of any original material that you own and include in feedback.

Do not send material that you do not have the right to share.

12. Third-party services

Certain Ochly features rely on or interact with third-party services or operating-system features.

These may include Android system services, Google device backup, Formspark, Gmail, ChatGPT Sites and apps or services you personally choose when sharing or saving exported information.

Third-party services are operated under their own terms and privacy practices.

Ochly is not responsible for changes, outages or actions of a third-party service that are outside Ochly's reasonable control.

13. Availability and updates

We aim to keep the Ochly website and beta app available and useful, but we cannot promise that every feature will always be available without interruption.

Maintenance, software updates, testing, security issues, device compatibility problems and circumstances outside our reasonable control may temporarily affect availability.

We may update Ochly to improve functionality, fix bugs, improve security or prepare features for release.

14. Our responsibility to you

Nothing in these Terms excludes or limits responsibility where doing so would be unlawful.

In particular, these Terms do not exclude or limit responsibility for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation; or
• legal rights and remedies that cannot lawfully be excluded or restricted.

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of that failure or of our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable or that was not caused by a breach or failure on our part.

Your statutory consumer rights are not affected by these Terms.

15. Ending your use of Ochly

You may stop using the Ochly website or beta app at any time and may uninstall the beta app from your device.

Ochly may suspend or withdraw beta access where reasonably necessary, including where these Terms are seriously or repeatedly breached, the beta is being misused, continued access creates a security or technical risk, testing requirements change or the beta programme ends.

Where appropriate and practical, we will explain the reason for ending or suspending access.

16. Privacy

Personal information is handled as explained in the Ochly Privacy Policy.

17. Changes to these Terms

Ochly is an actively developing product, so these Terms may occasionally need to change.

Changes may be made to reflect new or changed Ochly features, changes to the beta programme, changes to third-party services, security requirements, legal or regulatory requirements or the transition from beta to public release.

Material changes will be made clear where reasonably practical.

The latest version will be published on the Ochly website with an updated revision date.

18. Applicable law and disputes

These Terms are subject to applicable UK law.

If you are a consumer, nothing in these Terms removes any mandatory legal rights or protections that apply to you where you live.

If a dispute arises, please contact ochlyapp@gmail.com first so that we have an opportunity to try to resolve the issue.

Nothing in this section prevents either party from using any court, regulator, alternative dispute-resolution process or other remedy available under applicable law.
